Your purchase order will be scheduled into production once GORGEOUS COSMOS PVT. LTD. has accepted the purchase order, received delivery of the raw materials, and received any required deposit. All deposits are non-refundable. Effective January 1, 2022, a 2% convenience fee will be added to all credit card transactions.
Upon placement of a purchase order, component and raw material procurement, as well as graphic design work, will begin. Prices, terms, and conditions listed in the purchase order are valid for sixty (60) days from the date of issue, subject to unforeseen circumstances.All costs are ex-works at GORGEOUS COSMOS PVT. LTD. warehouse in Boca Raton, FL. Shipping charges are estimates only and may change.
Private label products are non-returnable. Large orders may be subject to a +/- 10% quantity variance. All product claims must be submitted within seven (7) days of receipt. You are solely responsible for all provided artwork. GORGEOUS COSMOS PVT. LTD. is not responsible for any trademark or copyright infringement on product names or artwork selected and/or provided by the customer.
You represent and warrant that any trademark or artwork provided to GORGEOUS COSMOS PVT. LTD. is your property or that you have the right to use and reproduce said trademarks and/or artwork. You are responsible for ensuring that your products comply with all applicable laws, regulations, and ordinances, including their labeling and marketing. You must maintain all licenses, permissions, authorizations, consents, and permits as they relate to your purchase orders and products. Notwithstanding the above, GORGEOUS COSMOS PVT. LTD. will collaborate with you and provide input and guidance on your products’ compliance with applicable laws.
GORGEOUS COSMOS PVT. LTD. expressly disclaims any warranties, either express or implied, as to the legality of your products, their labeling, marketing, and/or their conformance with applicable laws, regulations, and ordinances. Additionally, you acknowledge that GORGEOUS COSMOS PVT. LTD. is not obligated to independently verify your products’ conformance with these laws. GORGEOUS COSMOS PVT. LTD. reserves the right to liquidate all unpaid orders.
In the event GORGEOUS COSMOS PVT. LTD. needs to take action to collect amounts due on any purchase order, exclusive jurisdiction and venue for such actions will be in a court of competent jurisdiction located in Delhi, governed by Indian law. You agree to submit to the personal jurisdiction of Florida and waive the right to a jury trial. GORGEOUS COSMOS PVT. LTD. will be entitled to reasonable attorney’s fees and costs in any collection action, including appeals.
In the case of any conflict between these Terms and Conditions and any manufacturing agreement you enter into with GORGEOUS COSMOS PVT. LTD., the provisions of the manufacturing agreement will prevail.
